Electoral Commission unpacks seat allocation for Provincial Legislatures

This advisory note seeks to unpack the seat allocation for provincial legislatures, using the KwaZulu-Natal (KZN) province as an example.

In the 2024 provincial elections, 32 political parties and one independent candidate contested KZN’s 80 provincial seats. Upon the finalisation of the capturing of all provincial votes, the Electoral Commission allocated the seats using the seat calculation formula, as prescribedin terms of Schedule 1A of the Electoral Act.

The number of seats per province is as follows:

This is how the process unfolds:

  1. Calculate the quota = (Total valid votes divided by number of seats in the KZN provincial legislature + 1) + 1; disregard fractions.
  2. The quota based on the total valid votes of 3 508055, is thus 43310.
  3. Divide the number of valid votes for each contestant by the quota.
  4. Calculate first round allocation – see below – of the total number of seats of 80, only 74 seats are allocated in the first round allocation.

Note that the National Freedom Party (NFP) does not receive a seat in the first-round allocation. Only the African National Congress (ANC) (13), Democratic Alliance (10), Inkatha Freedom Party (IFP) (14), and Umkhonto weSizwe (MKP) (36) receive first-round seat allocations.

  1. 80 seats – 74 seats = 6 seats that still need to be allocated.
  2. These 6 seats will be allocated by ranking the highest remainders in a second-round seat allocation.
  3. The highest ranked remainders are as follows: EFF (ranked first), DA (second), ANC (third), MK (fourth), IFP (fifth) and NFP (sixth).
  4. In this second round, each of these top six ranked contestants received one seat, which is then added to the number of seats allocated in the first-round seat allocation to give the total number of allocated seats.

The NFP receives zero seats in the first-round allocation, but receives one seat in the second-round allocation based on the highest remainder. So a total of one (1) seat is allocated to NFP.
